1. Migration from the USA to Germany
The USA is one of the most important immigration countries for Germany, both in the area of educational and labor migration. The USA is not only one of the leading countries of origin to Germany in the area of skilled and educational immigration , but also in other types of migration. Americans also apply relatively frequently for a so-called "Golden Visa" for Germany, especially in retirement . This visa enables wealthy individuals who invest in Germany to obtain long-term residency status.
Due to the political and cultural ties between the countries, US citizens are privileged in Germany when it comes to applying for residence permits. For US citizens, this not only applies to visa-free entry into Germany (see the Federal Foreign Office visa list ). Rather, people from the USA, unlike other nationals who can enter without a visa, can also apply for a residence permit directly in Germany . Due to the visa requirement, most nationalities must travel back to their home country and apply for long-term residence from there. This is not the case for US citizens, however. US citizens can therefore enter Germany without a visa and also apply for a residence permit here directly, without first having to apply for a new visa at the German embassies in the USA (Section 41 of the Residence Ordinance).
2. Visa-free entry to the USA
For visa-free entry for American citizens, it is necessary that the general requirements of the Schengen Borders Code are met (see Art. 6 Schengen Borders Code (EU Regulation 2016/399) . This primarily means that people from the USA must have a valid passport to enter the country. The passport should also have at least one blank data page, as US citizens also receive an entry stamp when entering Germany. Another requirement for visa-free entry for foreigners from the USA is that they can prove the purpose of their entry at the border and finance their stay in Germany. In concrete terms, this means for business trips, for example, that you must show a corresponding invitation letter from the inviting company at the border and a hotel booking.

2.1 Stay up to 90 days
After successfully entering Germany, people from the USA can stay in Germany for up to 90 days within a 180-day period without a visa (Section 41 of the Residence Ordinance). The EU Commission provides the so-called “ Schengen calculator ” to calculate the 90 days precisely. The stay of American citizens can also be extended after 90 days if a residence permit is applied for at the immigration office during the visa-free stay. In this case, the so-called “ fictitious effect ” takes effect, which legalizes the stay until the immigration office has decided on the application for a residence permit (Section 81 Paragraph 3 of the Residence Act). 2.2 No work during visa-free stay
Visa-free entry for US citizens generally only applies if no gainful employment is carried out in Germany. In this respect, a visa or residence permit is always required to carry out gainful employment, regardless of whether the foreigner comes from a privileged country such as the USA or not (see Section 4a Paragraph 1 of the Residence Act). The only exceptions to this are the so-called “ non-employment fictions ” (Section 30 of the Employment Ordinance). According to this regulation, US citizens are allowed to pursue certain activities in Germany during a visa-free stay, although these are very limited. A frequently used permit-free activity for people from the USA is, for example, business trips or participation in trade fairs . It should be noted, however, that the non-employment fictions do carry some risks. If the limits of the permit-free activity are exceeded, this is illegal employment. In this case, severe penalties are threatened (see VISAGUARD information on illegal employment of foreigners ). 3. Apply for a visa at the embassies in the USA
A visa must be applied for in the USA at the relevant embassy or foreign representation. The following German foreign representations exist in the USA (usually called “consulate general” in the USA):
3.1 Responsible Embassy USA
Which foreign representation is responsible for your case depends on your place of residence in the USA. On the website of the German embassies in the USA, you can check which administrative districts the foreign representation is responsible for. The embassies in the USA provide their own “consulate finder” for this purpose.
3.2 Necessary documents for a US visa to Germany
You can also research which documents you need to submit for your visa application from the USA on the website of the respective embassy . The embassy provides a leaflet for each category with the documents required. Leaflets are available for the categories “Work Visa”, “Research Visa”, “Study Visa” and “Family-Reunion Visa”. Within the categories there are then subcategories for the specific visa.

3.3 Get a visa appointment in the USA
As soon as all the necessary documents are available, you can book an appointment at the embassy . You can use the RK-Visa appointment booking system for this. Unfortunately, the embassies in the USA have similar scheduling difficulties as other embassies around the world. However, it can help to prepare the visa application properly and then contact the embassy by email or contact form with the documents already prepared and ask for an appointment. If the application is well prepared and the embassy staff see that processing is quick, they may sometimes grant a special appointment. The Federal Foreign Office provides a list of all embassy email addresses .
After the visa appointment has taken place, the embassy or consulate general will review your application. The review takes about 2 - 4 weeks in the USA. After the review, you can collect your passport or visa from the embassy or have the passport sent to you by express for an additional charge. You can then enter Germany.
4. Residence permit for US citizens in Berlin
If you are already in Germany and want to apply for a residence permit as a US citizen, you must contact your relevant immigration authority . In Berlin, for example, residence permits for American citizens are issued by the State Office for Immigration (LEA). The State Office for Immigration provides special information for US citizens on its website . If you, as a US citizen, want to apply for a residence permit at the Berlin immigration authority in accordance with Section 26 Paragraph 1 of the Residence Ordinance, you must submit the following documents:
Valid passport
employment contract
rental agreement with indication of living space
Proof of monthly rent (e.g. bank statement)#
proof of your health insurance
The collected documents must then be submitted using the LEA contact form . The immigration office will then give you an appointment. Booking an appointment is no longer possible in Berlin (see VISAGUARD blog post on the abolition of the appointment system in Berlin ).
5. Retirement visa for US citizens
Many Americans come to Germany to retire here (or in Europe in general). Retirees in particular appreciate the opportunity to spend several months a year in Europe without having to deal with the strict visa restrictions for tourists . At the same time, many maintain their residence in the United States and use Germany as a convenient base for travel within the Schengen area. However, since no gainful employment is carried out during this time, it is not so easy to obtain a visa for retirement in Germany.
Unfortunately, there is no direct "Golden Visa" program in Germany, as is known in other countries. However, there are ways to obtain a visa through investments (see only Section 7 of the Residence Act). One option is to purchase a property or start a company (see Section 21 of the Residence Act). A corresponding visa can be applied for for an amount of around 250,000 - 500,000 euros. It should be noted, however, that the issuing of investment visas in Germany is at the discretion of the authorities . The embassy can issue the visa, but it does not have to. It is therefore advisable to commission a lawyer to arrange the Golden Visa or Investor Visa.

As soon as the Golden Visa/Investors Visa has been issued, it can be converted into a permanent EU residence permit (Section 9a of the Residence Act) after a few years. The permanent EU residence permit allows you to stay in Germany permanently and does not expire if you travel abroad (see Section 51 Paragraph 9 of the Residence Act). With the permanent EU residence permit, you can therefore spend large parts of the year in the USA and then come to Germany and the EU for a few days or weeks on holiday. The permanent EU residence permit can also be recognized in other EU countries, so that it ultimately entitles you to permanent residence throughout the EU without expiring if you travel abroad.
6. FAQ Visa as a US citizen
Do people from the USA have to have a recognized qualification to work in Germany?
No, Americans are usually allowed to work in Germany without qualifications (Section 26, Paragraph 1 of the Employment Ordinance). Normally, strict regulations apply to the issuing of a work permit to foreigners. For example, foreigners must generally have a recognized qualification (see Section 18, Paragraph 2, No. 4 of the Residence Act). However, this does not apply to Americans.
Can US citizens work for foreign employers in Germany (e.g. remotely)?
Yes. Normally, it is not possible for a foreigner to work for an employer abroad in Germany (Section 39, Paragraph 2, Sentence 1, No. 3 of the Residence Act). However, this does not apply to Americans. Americans can therefore also apply for a work permit for a foreign employer (see Section 26, Paragraph 1 of the Residence Act).
Are American citizens affected by the new ETIAS regulations?
Yes, since American citizens can enter visa-free, they will be subject to the European Travel Information and Authorization System (ETIAS) from mid-2025.
How long does a visa process from the USA take?

What is the most common purpose of stay for Americans?
Numerous young people from the USA come to Germany to study here or to prepare for a degree course. Particularly noteworthy is the high number of academic professionals who come to Germany as part of labor migration under Section 18b (academic skilled worker immigration) or Section 18g (EU Blue Card). According to the BAMF monitoring of educational and labor migration, Annual Report 2023, the USA is proportionally overrepresented in terms of work visas compared to other countries.
